Well, it happened to me at 9:30 am this morning, not even 100m from my apartment. I was heading north on Birchmount, I was just accelerating from the light at St Clair. I was in the right lane, and stopped on the right hand southbound lane was a "Recycling Matters" cube truck with the hazard lights on. Well, de decides to do a U-turn right in front of me. I slammed on my brakes, laid on the horn, drove my front right wheel up over the curb at full brake. BOOM! my front left side hit his front right. We stopped, obviously, to exchange info. He started trying to say that I tried "sneaking in front of him" while he "HAD to do a U-turn". I yelled at him "You didn't have to do a U-turn, who does a damn U-turn in the middle of Birchmount?! There are many big enough driveways and even a Shell right there (I pointed to it) that you could have safely turned around in!!"
Well, another guy who he cut off stopped, started yelling at the truck driver with me, and gave me his name and number as a witness to the accident. After all the info was exchanged, the dude left since it was a work truck and he was working. I had alreayd called my dad, so he was walking to the intersection. I picked him up, went to report the collision at the reporting centre right beside Scarboro Mazda. I filed my report, they took pictures, they put the witness name and number in the report. Went home, called insurance. They said they are doing an investigation, talking to the driver and witness to see who's at fault. I explained what happened to the insurance woman, she said a private investigator will contact me Monday for exact details of the incident.
She said if he really was U-turning, he would be 100% at fault and in that case I won't have to pay a cent, not even my deductible. She said his insurance would cover it all and he would have to pay his own deductible for the collision.

That sucks Al!! Atleast you have a witness prooving he pulled a u-turn, which definately puts him at fault 100%.....and now you can get your hood painted to cover all those chips :chuckle

Was going about 40-45 when i slammed on my brakes, probablky hit at 10-15k/h. Sorry but at that point in time my speedometer needed the least attention.

Haha, I dont think my hood is damaged! but at least my bumper won't have black dots all over it anymore for another 10,000kms or so. hopefully the shop paint is better than mazda paint.

I'm still going to the fall tour tomorrow with my car, despite the damage. Not going to let it ruin my fun!

Sorry to hear Al. That said, it could have been worse and glad you walked away without a scratch. The car can be fixed. :)
Yes, if you have a witness who saw him doing a U-Turn, he is completely at fault and his insurance will pay for everything in the end, inclduing your deductible. Good luck guy...

sorry to see that al...I take the time now to consider options...autoexe front bumper? and that rim can easily be repaired.

Sorry to hear about your car. I am sure you will have it fixed in no time. Good thing you have a witness to make it easier to proove it wasn't your fault.

Thanks everyone for the encouragement. Vince, I can't really afford anything at all right now so OEM is all I want on it, but I had the same thoughts as you. I think I'm finally realizing what happened. I went from angry to depressed lol.

Dude! I feel your pain. It doesn't look too bad and you didn't get hurt, so cheer up things could be worse. =)

I love the fact that car manugfacturers have designed cars to disintigrate the second they touch anything solid. Remembers when bumpers served a purpose?

I broke the tabs off my emblem and it is stuck on with double sided tape and needs to be re-painted. I'll do you one better, I can take yours off and bleach it and paint it for you. Will take about a week. Then just pop it back on. I did Phil's and Diego's emblems, and I know Diego was really happy with his. Hope I spelled your name right...

I can do it for sure. Just provide two big jugs of bleach (both 4L or more). I think I saw you today BTW. At Eglinton and Lebovic. you were at the light going stright on Lebovic through Eglinton. I was in the right turn lane waiting to turn right on Eglinton. I beeped and waved but don't think you/they saw me. Was with my busted ass car lol.

I took all my decals and vinyls off. I just have the black emblems, and I also removed the Mazdaspeed3 off the hatch.

I hate and always hated cube trucks... For some reason they are the careless ones in the street... He had his hazards, and attempted a u turn... 100% his fault atomatically...
Hope you get something out of this after your car is repaired...

Got a call from insurance today. I am not at fault! Nothing is going on my license, my insurance is not raising because of this. I don;t have to pay my deductable, my insurance waived it. The other dude will have to pay his, though. I'm also covered for rental while my car is in the shop. I'm taking it to tip-top on Danforth and Pharmacy. My insurance has life time paint and body work warranty for their preferred shops, so I just decided to go there.

I'll just be glad to get an MS3 bumper again. I have a feeling they have never worked on an MS3 before and will order the MZ3 bumper then realize afterwords that it doesn't fit.

Your fault or his.. a lot of damage or not.. there is NOTHING worse than getting in any type of accident with your baby. She's never the same.

Well, I took my car in and got my rental today. It's a 2l Mazda 3 sedan. It was either that or yet another Kia Rio, so I took the MZ3. It's of course auto and its sooo slowwww. =[
Oh well, my car should be fixed soon. The rental place deals with them a lot and they said this body shop generally doesn't take very long.

Because I had the wheels turned and the car was sliding, the front wheel ended up hitting parallel to the curb, snapping the drive axle. Hopefully all the insurance and fault stuff will be sorted out for you soon.

Really not sure. My insurance dealt with the quote. $2843 was the grand total on the parts, labour, and new rim/tire from Allen.

looks like $3000 of damage... but consider yourself lucky that the bumper took the brunt of the damage... I don't see any damage on the hood or broken headlights :)

SOOOOOOOOOO glad to finally have my car to go to work and back in today. I had an MZ3 GX as a rental, so I can't say too much about it. BUUUUUUUUTTTT I'm glad I can finally turn the radio past 1/2 without it distorting like nuts, glad I can finally actually move when I press the gas pedal, and I'm glad I don't have a stupid automatic gearbox that always needs to shift into 2nd below 10km/h when rolling and never go back to first even if I full throttle it.
Lets just say, my MS3 seems even more worth every penny right now. =)
