Stumbled upon this in the Star...it makes sence because I have asked for court dates on 3 parking tickets and I have NEVER had a court date.

hehehe, funny cuz in mississauga too you will never get a court date, i think they have only one judge there! :)
and the fact that after one year the case get dismissed, you will never be fined.

That's really good info. Same idea as the general rule for speeding tickets... Just fight it anyways. Worst case scenario, you have to pay it, which you'd do anyways. It's worth a shot!

Not surprised. I think I have 2 parking tickets (been so long I can't remember - but I know I have 1 for sure) still pending.

WTF, every time I go try to fight it I get a trial date. And they show up too.

Just a heads up, I heard on the news last night that Mayor Miller (my unoffical god of politics *sarcasm*) is going to try and either un-backlog the tickets or put in a system where you write a essay to a judge to plee your case. If either happens there are problems in both plans.

Un-backlog- if they do give you a court date and it's more than a year from when you requested the date you should get the ticket tossed out because every Canadian has a right to a fair and speedy trial. This goes for speeding tickets too! If you ever get a court date out of the blue and it's years from when you pled not guilty (when you ask for a court date that is how you plee) and they take you to court simply state that it was so long ago and you feel as a Canadian you are not getting a fair trial because the date was x years ago and your memory is not as clear as it could have been 6 months from when you asked for the court date.

Write a 1000 word essay to pled your case- This is the DUMBEST idea Miller has come up with. Like really, and in what language? You can write your drivers exam in 27 different languages so if they don't let you write you plee in 27 different languages how can I get a fair trial? My mother tongue is pig latin mixed with gibberish and that is how I will write my essay. Plus in what other country do you write into a judge? If I'm going to court to battle my ticket I want to go infront of a judge, not have him judge my spelling and grammer.

All in all just be careful as now this loop hole is in the media and they are going to try and fix it...probably unsucessfully too!

This has been thrown around here on TM3 and a couple members have tried that "not a speedy trial, so my ticket should be tossed" and the judge says - nope - it's reasonable with everyone tying up the courts that you will have to wait a long time, so you're playing a hit and miss game with judges.

I went to Woodbine Beach yesterday, it was mad packed so I parked on the grass like everyone else did. At the end of the day, I got a parking ticket from City of Toronto for $105.00. The parking infraction was: PARK VEHICLE IN PARK - NOT IN DESIGNATED AREA. What are my chances of fighting it off? Are there any valid reasons that I can use?

Sorry I can't tell if you're being sarcastic or not. But when I arrived there, there were enough cars to give me the cue that I was able to park there because of July 1st.

The only sign was the green circle P with 1 hour parking Mon-Fri 8am-6PM under it. The other sign was nowhere near my car or location. Should I fight it?

Always fight it!

The problem with claiming that your rights were violated by not having a speedy trial, is people do not fill out the paper work and then stand infront of the judge and trying to do this. In order for it to work, you must start filling out the forms for a charter violation as soon as you get the trial notice saying when your hearing is. If you fill out the forms, they will drop it as early as 8 months after the charge was laid.

damn i wihs i knew this,

but i have a freind before he didnt pay for his 3 tickets, i dont knwo if he file a trial date,
but when he need to get his new emisson sticker , the mto wont allow him unless he pay off that ticket???
or when need need to renew his driver liecense???

anyone know??

That's true if you have unpaid parking tickets but if you file for a trial date it should not go towards your record unless at tiral you are found guilty (I think).
