PORT HOPE – An Ontario driver has learned a hard lesson about respecting authority.

He was pulled over for speeding on Sunday on Highway 401 near Port Hope after being tracked by a police helicopter.

Police say the driver was stopped and ticketed for travelling 35 kilometres over the posted speed limit.

After he received the ticket and began to pull away, the driver raised his hand and flashed an obscene gesture toward provincial police Const. Bettina Schwarze.

She pulled the unidentified man over again and promptly gave him a $110 ticket.

The offence? Making an improper hand signal.

in the states, there was this guy who flipped a cop off as he passed him before and he got in jail.... he sued the cops, went all the way to the supreme court and won because based on freedom of speech

it should've been the same way in commie canada

that's up to interpretation... the "traffic hand signal" is just something used to make this stick to him, how can it be one anyway?

if this guy works it through the system, I'm sure something will come out of this

Take it to court is all i can say its a freedom of speech doesnt matter if you give a law enforcement the finger or a bum you are showing your aggression not violently not verbally just a symbol. Thats rediculous

I think the guy deserved it, just because he was an IDIOT.You don't flip the bird to a cop that just gave you a speeding ticket! :loco You thank him/her nicely and wish them a nice day....This method might just be enough to make them waiver and make a note to miss your court date. :)

Sorry, I didn't realize speeding was a right. I thought it was a violation of the Highway Traffic Act.

As for the finger thing, if his arm was extended straight out, parallel to the ground then his hand signal was correct for a left turn to merge with traffic. If his arm was bent up at the elbow then he was signaling a right turn which is clearly the incorrect hand signal when turning left to merge with traffic and presents a serious safety problem.

yes, it *maybe* a plausible "hand signal" if he stuck his arm/hand out the window... but we don't know if he did or not because we don't have the true story

either way, his freedom of speech right got violated when he got a ticket for that!

Honestly if anything he should have been charged with disrespecting an officer. This was a lesser charge, he should be thankful!

Freedom of speech is not a right under Canadian law or our constitution. Freedom of speech is a freedom, subject to regulation. Gratuitous abuse of another person stemming from petulance and frustration with one's own foolishness - ie, getting caught breaking the law - is certainly something which should be regulated and the officer in this case found a clever way to apply said regulation. Sadly, this charge will probably be dropped. But the officer was right and fingerboy was wrong.

He was breaking the law by speeding 35 over. Don't be mad at the cop for pulling you over because you're breaking the law. If he hadn't broken the law, he wouldn't have been pulled over, and he would have had no reason at all to give the cop the finger.

When this goes to court, the finger fine will be dropped, but you can be damn sure the judge will flip the bone-head speeder the finger if he asks for a reduced speeding fine - full fine and points for him - serves him right for being a dumba55. :)

Freedom of speech or not, he deserved it. What happens when you flipped the bird at your teacher/principal/dean and got caught - I'm sure they didn't just sit there and let it pass. Hell if someone gave me the finger for any reason, I wouldn't just sit there and take it.

Wanna be an ass? Then prepare to get the same treatment in return. People these days treat life like it's a one way street way too often.

People also don't seem to realize how limited Freedom of Speech really is. While you are free to utter "I'm going to kill you" to someone, it is still against the law.

If your definition of freedom of speech is the right to say anything you want or flip people the bird completely without consequences, well, that's never existed.

You have the right to say anything you want. That doesn't mean there might not be some consequences.
