View Full Version : Got a parking ticket for parking in MOTHERS EXPECTING

Alright, heres the deal.
I work at Sherway Gardens, if anyone knows what parking is like around there, you'll understand. Anyways I was coming in to work and while spending about 10-15 minutes looking for a spot. I found a vacant mothers expecting spot. Now, from what I know this is a courtesy spot, and me being frustrated with parking, I decided to take it.
This happened around noon. Now around 4pm I got a ticket on my dash for parking on private property without the consent of the owners permission. By the city of Toronto. Now I know this was issued by the security there, as they have the authority to issue such tickets.
Now, should I fight this? Say I was shopping with a friend who was expecting? Will this reach court? Can I win? Will they use video evidence on this matter?

Sucks to hear this but you should have not parked here in the first place. I know parking can be fustrating but those spots are saved for mothers expecting lol. But honestly, if you are expecting u shouldnt even be at the mall.
But i would just take this as a lesson and man up to it and pay it

just pay it.
i was in the same situation last year. i parked on the hash marks at the end of a row, and came back later on to a $30 ticket.
i paid it....eventually.

But legally speaking these spots are COURTESY spots. Yes I am at fault for being a jerk, but at the same time I'm not at fault for parking in a legal spot. They don't know if I had a mother inside waiting for me or anything.

How much was the ticket
$30.00. just not the point. They have issues tickets on me in the past and its racked up. I owned up to the others but this is ridiculous.

The only thing is 2 years ago i got a parking ticket at my doctors office which is the same parking lot as the BGH..i had an emergancy appiontment and when i went their thier was no parking so i parked on the snow bank and paid for a ticket and put it on my dash of my truck..when i got out i had a$20 parking ticket...which i got not even one minute after me parking their i got mad about the ticket so i took it to court and in the end i lost and from a $20 it cost me $36 casue i had to pay court costs...it might not be worth fighting the ticket

I know, Im afraid of losing. Im trying to look up anything I can on this matter but I dont seem to find any by-laws on "mothers expecting" parking spots.

The only problem is how would you fight it in court when your not pregnet..haha

Just pay up. Security was probably watching or someone complained. If I were an expectant mother and saw a dude park there I'd be looking for blood for making me walk from the back of the lot.

if you're right and it's a courtesy spot with no bylaw tag attached to it I'd say fight it, no law against it. Especially the way that the ticket was worded, the ticket says that you were charged for parking without the owners permission, all you have to say to the judge/justice of the piece whatever is
1) I work at that establishment, what do you mean that I don't have permission to park there? show him/her some proof that you work at that address, then pick up your stuff and walk out of the court, without paying a cent. This will work unless of course there is some sort of legal document/agreement between the landlords and the tenants of the facility that was "properly" explained to you and that explanation documented that you received and acknowledged that you that there are only certain areas of the lot that employees are allowed to park in. If that's not there. Without that there is no way that they will be able to win that ticket, now the wrinkle is who is actually the "prosecution" the city of Toronto issued the ticket but the complaintant is sherway gardens, so they are the ones that will have to prove the allegation, and not the city. they may or may not be willing to show up to court to prove it, in which case you'd win by default.
Just pay up. Security was probably watching or someone complained. If I were an expectant mother and saw a dude park there I'd be looking for blood for making me walk from the back of the lot.
Exactly! Regardless if it's a courtesy spot, you weren't using that spot for it's intention.
Therefore, you're parking illegally. As far as I'm concerned, it's no different than you parking in a handicapped spot.

Pay up and don't be a dick and park in those spots next time. From someone who HAS a kid thats in a baby seat, its a pain as it is to get them in and out let alone having to walk half a mile carry a car seat/ small child somewhere. Sure, we may have a stroller, but they aren't easy to work with either. And yes, these spots are for "expecting" and "new borns", don't take the sign too litteraly.

Unless you showed up to court with a baby or someone who was pregnant who is willing to lie in court for you, I'd be too embarassed to show my face in that courtroom, and g-d help you if you get a justice who happens to be a mom as well. Chalk it up to stupidity, and pay the stupidity fee.

Since Sherway owns the lot, they are completely within their rights to decide who can can park in the lot, and even where in the lot they allow people to park. They "expectant mothers" signage says that they are only permitting pregnant women to park in those spots - i.e. the are the only ones with permission to park there.
So the "courtesy parking spot" argument holds no water. Pay the ticket, get on with your life.
BTW: you may have been frustrated at not being able to find a spot... think how an eight-months pregnant women would feel having to cross a slippery, snowy parking lot.

next time you should put a baby seat in the back (secured of course) and you can park there anytime =) *sarcasm* but yes pay up and learn your lesson.

just pay it up. Not worth the hassle and work days off to fight off a 30 dollar ticket. It's Pretty hard to fight the ticket if you don't show up with a baby or pregnant mother in court... and if they got hold of the tape of you returning to the car without a pregnant mother gg :P

Pay it... Simple as that. You parked in a spot that is designated for Expecting mother's. I used to date a mother and you should see how mad she gets when she see's people parking in that spot. She has a 2 year old now but when this happened she had a 6 month old. I had the baby seat... so I was ok :chuckle.

If it's a city of Toronto ticket, put in for a court date and it'll disappear!

4 Hours? Is there a time limit on the spots? Some parking lots have a 3 hour limit with signs posted so perhaps they marked your wheel.
As you work in the plaza, is there any rule about where staff/employees are to park (in back or at the far end of the lot)? Maybe they have your plates logged as staff and decided to ding you on that.
In any case, not worth it to fight. Just pay it and move on but make sure you know why you were ticketed and don't get caught again.

Hmmm...maybe I should stop parking in the Hybrid Only spots at Loblaws:chuckle
The have about four of them, and I was parked next to an RSX, a Trailblazer and MKS :chuckle

Sorry, but when my wife was 8 months pregnant and we couldn't find a spot because people like you take them and i have to help her hobble into the store from a parking spot a mile away I feel no sympathy.
Same with the spots for parents with young children. I hate seeing people with no kids, no kids stuff even in the car pull in without a care. Obviously these people have never tried toting around with a toddler in tow

I believe the OP was questioning whether Toronto officers should/could ticket for parking in expectant mother parking. That they could do that surprised me too, I thought that kind of parking was voluntary not by-law enforced.
He knows he shouldn't have parked there, but I too am surprised he got a ticket.

Don't think they would see a baby seat in the back of a single cab pickup truck. lol unless they open the tailgate.
ahahah to the above poster of that article. Awesome.
Im aware of my wrong, but at the same time one can get really frustrated looking for parking for a while, especially if you come to work early but end up being late just because of a parking spot.
I parked at 12pm, ticket was issued at 4:01. No way they were watching me. Someone just decided to ticket me.

Lady comes in "The machine ate my money" ... which one? The one with the garbage bag... Her excuse..... she thought ... I'm not even joking ..... the garbage bag was keeping the machine warm..... WOOOOOOOOOOOOOOOOOOOOOOOOOOOOOW.
second case of stupidity.... woman comes in when I press the keypad it keeps taking my money...keep in mind she is pressing the INSTRUCTIONS!!!!!!!!!!!!!!!! where it tells her to press the keypad below she is pressing the plastic instructions for 20 mins and is curious why the hell it doesn't work!!! ...... F#@$$#$*#$#$K I need a drink and a smoke.
Seriously... pay that shyt lol
I park then when I have my God daughter, and trust me.. .those spots are a savior when you have a baby and you gotta lug the kid outta the car seat and all the other crap that goes a long with it.

A little off topic of this thread but...
That brings up a good question. If there is a black garbage bag over the meter, do you get to park there for free?
Who's not going to park in an available spot?
Could you fight a ticket for parking in that spot?
Hmmm.....

Ya but parking in a handicapped/expecting mothers spot pisses off only the people needing to park there. People on bikes pisses off every motorist and pedestrian....maybe even god.... j/k :chuckle
