OK, so after the game on Sunday we went for the parade down Yonge street, we had a great time but, my friend got pretty drunk and thought it would be a good idea to jump on the roof of my car and lay on the hood.

Ok, checked it Monday morning and it looked pretty bad, really dented on the roof. So I take it to MOT. They called today and said it’s $3600 to fix everything.
Now I thought maybe I should look around and find something cheaper, but why the hell should I. He ****ed up my car.

He so far is willing to pay but he says “I can’t pay all at ounce”
I feel sick, this is my best friend and now he owes me all this money. I will talk to him tonight and see how we can work out payments, but I am so stressed with this right now.

Now i don't know your friend but i do know some of my freinds and their word means shit when it comes to money owing and i would make them pay at once instead of payments.

Another option would be to claim it on your insurance and have him pay the dectuble..Me personaly i would go that option..$3600 is alot of money for someone to fork out and pay.

Either way that sucks that this happend and good luck

Draft a contract and have the both of you sign it. It should be legally binding right, if there's both signatures?

Definitely not going through my insurance for his ****up.

He is a really good friend, not some casual friend. He was my best man when I got married.

I’ve talked with a couple other mutual friends and they’ve all reassured me that he will be good for it. I’m going to try and work it out tonight and make it so he pays all at once, not payments or BS like that.

Comprehensive won't hurt your rates at all (I'm pretty sure you can just claim it under that, say some jackass vandalized your car ahhahah, which is true...)

Hell I went through insurance for damage less than a third of that cost!!! Screw paying out of pocket that's what insurance is for. Plus your friendship with him might never be the same after this... that's a ridiculous amount to pay.

I had this happen a long time ago. Friend was using my car and went over a curb destroying the side skirt and rocker panel and some of the door. $2200 to fix. I was lucky enough to have him pay for the whole thing, but I also felt like crap because after all it was my best friend.

Unless he pays for the whole amount right away, definitely get something in writing. That sucks but you have to cover your ass since he was the one who made the mistake.

^ I agreed with the aforementioned. To have a friend pay that amount out of pocket is ridiculous. I'd just go through insurance and make him settle for the deductible and give him a kick in the nuts so he doesn't do it again.

I agree with this saying. This way you save your friendship and he only pays your deductible. Plus your premiums wont go up because you are not at fault

I think whenever your make a claim to fix your car without other company paid for, insurance count @1 fault on your record (check your insurance before making a claim). If you have another claim @fault or nobody paid for then your insurance will be skyrocket. It happened for me a few year ago. Double check it won't hurt.

It's not a "not-at-fault accident" claim though, it's comprehensive... At least with my insurance company, that covers everything from vandalism to simple windshield replacements.

Also, lots of insurance companies offer accident forgiveness now. And no, there are no strings attached to this benefit :chuckle That only covers at-fault anyway.

JSI, you'll be fine, just call your insurance company and ask them a bunch of questions! Claims departments are usually open 24/7. Plus you can get the best work done possible without worrying about cost if you do it this way, and most likely they will give you a rental too. You might even get a few extra scratches touched up as a freebie while they're at it ;)

If he decides that he is going to claim it on his insurance he will need a police report...i think that is what rurocking meant by his comment

Wrong, actually. I made a claim recently, no you do not have to file a police report.

And again, it's not an accident claim, it's comprehensive.

Then again, who knows! This may vary for different insurance companies.

I thought that you need a police report for vandalism..but i'm no expert as i have never made a claim on my insurance

Yes, they will probably ask for a police report if you report the claim as vandalism. They may not though, its hit or miss with insurance companies. If they follow by the book, yes they will ask for a police report and if you put your friends name as the person who vandalized the car they may try to subrogate against him to collect whatever they pay out.

It will be a comprehensive claim subject to your deductible if you make the vandalism claim. That being said, I'd find it hard to ask my friend for $3600 when the insurance is there. One comprehensive claim will not affect your insurance rates. That being said, one comp claim, one collision claim, and one ticket could cause you to be dropped by some insurers. If you've never made a claim before though, I think making the claim would be how I would proceed.

For a contract to be legal - at least three requirements must be met:
1) Offer
2) Consideration
3) Acceptance

Simply having a signature on a piece of paper saying one will do X, without consideration won't stand in court.

I'm sure there is something that could 'bind' him to an obligation to pay, but I don't think it's called a contract.

if one of my friends did that i don't even know what id do. i don't know the whole story but if you allowed it to happen than you shouldn't make him pay for ALL the damages but if he just came out of nowhere and jumped on your car than he should pay it all...
i remember like 4 years ago in my mazda 626 driving down yonge street i see one of my buddies drunk off his ass walking down the street smoking a cigarette. i yelled to get his attention, when he saw me because he was so drunk he ran at my car opened the back door and dove in headfirst. not realizing what he was doing his cigarette fell out of his mouth and rolled around on my back seat buring it in like 4 places. tan interior too! i was so pissed and of coarse never saw a dime from him for it.

Just a little update to vent my frustration. Nothing to do with paying for the damages as that has been figured out.

Now the story on the work being done:

I drop the car of on Tuesday March 2nd. Get a call that afternoon saying it will take a couple days. Ok that isn't too bad.

I call on March 4th as I have not heard anything expecting to be told "The car is done you can come pick it up", Nope now it's the middle of next week. A little bit annoyed as two days has now become a week.

I call the body shop on Monday directly to see how the work is going. The woman on the phone is nice but tells me they will "Try" to have it done for Friday. The "Try" has a sort of, don't count on it feel.

I get a call from MOT on Tuesday saying pretty much the same thing, car looks good but will be ready Friday.

So now today, I call the body shop again hoping to be told "Should be ready tomorrow" or something like that.........................................

OH NO!!!!!!!!, I got told the 22nd.

****ING CHRIST!!!! how does "A couple days" turn into three ****ing weeks!!!!!

That sucks dude, i'd hate to be without my car for 3 weeks, especially for soemthing like a dent repair and paint job, id maybe understand a week give or take a day or two, but three weeks seems excessive, the job better be prestene for that kind of time.

Yeah, just the hood even. I was told on Monday the roof was done and just needed to be painted. So that would mean just the hood needs to be put on.

Had a rental last weekend that he is covering. We don't really need a car during the week so that's been ok. We are using his car this weekend.

Still it's a pain in the ass, the rental was a POS Kia Rio5, it really made me appreciate how nice the 3 is. His car is an old ass Focus. I had a Focus before that I liked, this car I am embarrassed to be seen in, still beats taking the bus though.

MOT service wont return my calls.
