Hey guys, I just bought the car today and just now when I was reading my carproof report carefully, I found there is a "miscellaneous accident claim" of 14,895 dollars..

The dealer who sold me the car promised me that the car's "accident free". He mentioned there has been a miscellaneous claim, but it's not an accident but a scratch or sth.. Only just now did I realize it could not have been a scratch since it's an almost 15,000 claim...

Can anyone please help me in regards to this huge amount miscellaneous accident claim?

Didnt you get to see the carproof before? Just curious.

And I think another member had a similar situation. If you signed the papers saying you know about the claim, then your screwed.

well maybe the damage was from hail storms? or maybe the car was fully repainted because it was really vandalized?

moral of the story: read everything before you sign
and you can tell the salesman to stick his foot in his mouth if he doesn't like that

Hey guys, thanks for your replies!! Well, I did not see the report before, cuz I thought the guy would not be lying since it's a big dealership.. well, that's a lesson learned for sure.. I did sign the contract, but I didnt see nowhere's written that I'm aware of the accident... Now I am thinking to call the salesperson and do some bargaining since I wouldn't have bought the car if I knew this claim..

With a ~$15,000 insurance claim it sounds like the car is salvaged write-off, patched up for a quick flip.

Is there a way to find out if the $15,000 repair was ever actually performed or was this just what an insurance adjuster said it would cost to fix the car?

The ownership paper would say rebuilt or branded

also - (much like my co-workers car) had 3 seperate accidents (all fender benders but repaired by dealership through insurance) averaging $5G per accident

New laws in Ontario state that if there is more then $3000 damage to a car, it has to be reveled. If they forgot to mention this to you, take the car back asap or threaten legal action.

if you sign a contract and the representing person of said contract misrepresents it, and you sign the contract based on the persons statement it makes the contract void. of course you need to prove that you signed it based on what the person said, something like this shouldn't be hard to prove

This is a general Paraphrase from contract law (had to study it for my technologist diploma) but essentially if you can prove that you agreed to the contract because of a direct misrepresentation meaning they told you a complete contradiction to the contract, not hiding anything then it will void the contract, and i doupt anyone in the right mind would think a $15,000 dollar repair job is nothing to worry about.

Hey guys, sorry for my late update. I finally got this thing done, the dealer took back the car but refused to refund, and I had to get another car from them.. I was content with the deal they gave me on the second car, but was really unhappy on them still insisting the first car was accident free till the very end, despite not knowing what the15K claim was actualy about..

In what fantasy world is this? There is no law to enforce this, sorry to say.

I was the other member with a similar situation, and was basically screwed over by the system, unless I wanted to take it to court. OMVIC and UCDA would do nothing for me, even though it was "misrepresented".
My dealer on the other hand would not even exchange the car, obviously wanting to get rid of it. You got off lucky, and my lesson learned, read the carproof very closely BEFORE signing anything!!
Stay away from Vision Fine Cars on Steeles!! lol
