View Full Version : Speeding Ticket - Wrong Name

So I searched the forum and couldn't really find a definite answer on this. I got a ticket about a month ago for speeding. The officer when giving me the ticket told me to go and fight it in court so I sent in for a court date. Last week I got something in the mail saying I owe the amount on the ticket and if I don't pay it by a certain date then I could lose my license. Now on this letter I noticed that my name was spelled wrong so I decided to check the photocopy of the ticket I made to see the same and it is clearly spelled Graig instead of Craig. Would I be able to fight the ticket on that basis? Maybe argue about the competency of the officer? Any help on this would be greatly appreciated!

It's an easy amendment to the ticket. As easy as it sounds to try and challenge it and claim the officer was not competent, I doubt it will hold up.

you never know, you could say If the officer was careless enough to spell my name wrong on the ticket who knows what other errors were made in lead up to issuing this ticket. I've been in court and have seen a lot of things go by while waiting for my turn
Something like that is hard to get away from, C vs G is very hard to distinguish at times.
When i worked collections if there was a difference in name, people would often contest it's not them, and well they would get away with it cause we had no real way of proving it
With you however they probably have your DL number, and know what you look like. Now if you know a Graig with the same last night maybe he can go in for you, but good luck either way

Looks like you don't have a court date and have been subsequently automatically convicted due to having past the allotted number of days you have to file for a court date.
If you have a court date, you don't get anything for 6-8 months. Then you get a letter telling you where and when.
Go to the physical place and file for a reopening, to reopen your case for a trial.

The judge won't let you off because the cop's C sort of looks like a G.
And you can't argue against competency without allowing the officer to argue about YOUR competency as well ;) It's got to be a fair trial, after all.

Yeah you could possibly have it thrown out.... happened to me except they got my birth date wrong (I was 51 years old according to the ticket hahah)... try anyway, you have nothing to lose!

that is an amendable error, provided your license or plate number is fully correct.
