View Full Version : "Family Defaulting" Will cause your Vehicle to be Impounded

I saw this while driving on the 401 information board that effective December 1st, 2010 that "Family Defaulting" will be an excuse for your vehicle to be seized. What the heck is that? I tried to research it but it didn't pop anything up or my googling is horrible today. I tried to find an article but so far its newto me. Fart on me if I misread it though I am aware of the under 21 zero alcohol blood level rule.

I would interpret that to mean if a household defaults on its insurance policy (ie. fails to payments on time), they can seize your vehicle(s) in order to prevent you from driving around without insurance.
Haven't read anything about such a law coming into effect though, so idk.

Scratch the above post, I found the law:
Ontario's Vehicle Impoundment Programs are aimed at making the province's roads safer.
In Ontario, drivers who operate a motor vehicle while under licence suspension can face one of two kinds of impoundment:
Vehicles driven in Ontario by persons apprehended for driving while their licence is suspended for a Criminal Code conviction will be impounded for a minimum of 45 days;
Effective December 1, 2010, drivers caught driving with a driver’s licence that is already under a specific Highway Traffic Act (HTA) suspension(s) - including default of family support, but not including suspensions for defaulted fines or medical conditions* will have the vehicle they are driving impounded for seven days.
Also effective December 1, 2010: Impoundments for:
Drivers required to have a vehicle ignition interlock device and who are caught driving without such a device; and
All drivers caught with a blood alcohol concentration (BAC) over 0.08 or who fail/refuse to comply with a demand (to provide a breath sample) made by a police officer under the Criminal Code of Canada (CCC).
These are in addition to the existing 7-day impoundment for drivers engaged in a race, stunt or contest on Ontario’s roads.

So it's to address deadbeat parents who skip out on child support payments.

Which is a silly law because impounding a vehicle of a deadbeat only removes his/her ability to pay the impound fee worth of child support. The shady tow truck companies get that.
Now if we had a government run impound lot where the funds used to remove the vehicle from impound were forwarded to the parent with custody it might be a different story...
I figured thats what it mean. If you don't pay child support they will take anything and everything from you. And I agree with it.

I can see where the government is coming from...they already suspend the driver's licence of parents who don't pay child support. Impounding their vehicle means that people with suspended driver's licences won't be able to driver a vehicle.

There are a lot of people driving vehicles without a license & insurance.

My father should have his picture plastered up there too. He owe's my mom 17 years of child support.
As a person who grew up not knowing my father and having him duck out on supporting me my whole life, I am not able to support this law in good conscience. Removing their means of transportation and having a private company hold it for ransom is ridiculous.
What if the deadbeat is a driver by trade anyways? They get their license removed and if caught driving have their vehicle impounded. How are they going to make payments if their means to make a living has been removed before a JP or Judge ever hears his/her case?

You DO know that if they get caught, then the FSU will know where he works and will have his wages garnished.

I've lived it. As far as I've witnessed, Family Services doesn't do as much as they say they will.

And many of you are missing the point of this law, the point of this law is to find and apprehend those defaulting on their family support payments. As you can see with the link prinsesa posted, many of them disappear and are never found again. Allowing the MTO to add this to their systems will assist in apprehension when these dirt bags run are driving around somewhere in Canada.

You just have to keep on following up with the FSU for child support, if you stop, your case wont move.
Make sure that everytime the payor doesnt pay, it is reported right away so he can accumulate that debt, so when he has a job, gets a pension, inheritance, EI benefits, WSIB benefits etc. Accumulated child support payments are deducted =D
