God forbid I hit anyone or anything for that matter, just curious what would happen if I clearly had the right of way and this guy popped out at the last second. I know I should always be in control of the vehicle and be aware of my surroundings, but let's say this was a possible insurance scam attempt and I could prove it.
Just curious is all.

Yes you should not hit them but some people are retarded and/or scammers.
I encounter many jay walkers every day and some of them do some really retarded stuff like try and run across the street before you come causing you to slam on the brakes.
A relative of mine got clipped by someone's rear view mirror while crossing the street on a crosswalk when it just turned red I think. Said relative got a ticket when the police showed up... Luckily no damages to the car.
Also another reason to have a dashcam. If you show insurance the footage and its clear that you had the right of way/ there was no way to avoid it (especially true with scammers that jump out the last second), it would make a big difference.

Insurance does not care if you have proof that they were in the wrong. You are 100% at fault.
There is a large misunderstanding between "police fault" and "insurance fault".
When the police show up and give the pedestrian a ticket for jaywalking, they are saying that this person is likely guilty of a misdemeanour offence. This is the police finding fault in the pedestrian. This has exactly nothing to do with insurance.
Your insurance company will still deem you 100% at fault and rate the claim against you.
Just like how you can hit a patch of ice and slide off the road into a tree. The police will come and say "oh, it's not your fault, you hit some ice" and not give you a ticket. The police have said you're not at fault. Insurance will still find you 100% at fault.

If you have proof* that the pedestrian is a scammer, you're still going to be rated for this claim.
You may be able to provide the police with proof* of the scam and they may attempt to charge this person with insurance fraud.
This investigation/charge/trial may take years to come to fruition and all along the way, you're being rated for the claim. Once the trial is concluded and the scammer found guilty, you may apply to FSCO's dispute resolution service to try and get the fault assigned by the claim reassigned. By this point it's possible/probable that the claim is off your record anyways.

That gentlemen is homeless. His name is john. He is harmless. but he is know to do that almost all the time. He has major depression issues as well a number of mental illness issues. I know him be cause I use to volunteer at the youth drop in center. Its about a few hundred yards up on Gloucester. He has a few screws lose but a nice guy. Please don't hit him.
I can sware it is john. Yeah I use to volunteer at OCH, or OGH as it use to be (operation go home) Which part of OCH dose you girl friend work at? I helped start the Bottle work, and bead program. They almost lost the funding but now know that program runs its self now. Such great to see at risk street kids have a place to call home even if its only for a few hours a day.
