The driver should have been aware that there was a fast-moving bike there, since he would have caught up and passed him while driving on the road. However, the cyclist shouldn't be riding on the sidewalk, and also has a responsibility to make sure he can safely cross that entryway without being hit. Same as a pedestrian, you can't just walk across and expect a car will see you. Doing so is just asking to be hit by the car.

I got nailed badly going north on Trafalgar in 2008. I was riding on the sidewalk because there was no bike lane on the street and it wasn't prohibited. I was going through a green pedestrian light when a BMW pulled up out of nowhere. At the last second I realized the driver was only looking left to check for traffic and roll a right through the red light. I went flying and my bike was wrecked. Police found fault 100% with the driver.
Not sure what you mean by this. Being in the larger and heavier vehicle, the driver must be aware of his surroundings at all times. I do constant mirror and spot checks when I'm preparing to make a right turn to make sure no pedestrians or cyclists are coming through.
As a cyclist and driver, both parties made a mistake but the fault should be on the driver.
I don't disagree with everything you said, but in the case of this video I would say the cyclist is 100% at fault. For one he should not be on the sidewalk period, we learn that as kids. Secondly, the cyclist was going at a pretty good clip, which again I think is against the law. He could have easily hit an unsuspecting pedestrian. Thirdly, I have a feeling the driver had no chance of seeing him as the cyclist was coming up the blind spot and there were obstructions also to hinder the view, such as a pole and utility box....
Drivers must be aware of cyclists but cyclists must learn they must be extra aware, as they will always loose the battle...common sense.

Agreed, I'll always let the morons do their thing whether I'm in my car or on my bike. Like I said, the cyclist made a mistake as well but there was significant distance between the sidewalk and road, meaning the driver should've been more aware. Also, it's hard to tell with the quality but it didn't look like they signaled. Like @Aitch mentioned, driver should've seen the cyclist at some point and known to practice extra caution.
There are always going to be stupid pedestrians and cyclists who make risky decisions, but I'd rather take extra precautions to avoid an accident. I don't want someone's death on my conscience, regardless of whose fault it was.
Most cyclists never pass on the right of a car when its in the curb lane. Risk of opening doors and right hand turns.

If I'm driving my car, no cyclist should be passing me on the right in the same lane I'm driving in. By being the larger heavier vehicle, if I hit you, you will not survive
Like I said, if you're turning right, a cyclist has no right to come past you on your right. If you do that as a cyclist, please stop doing it.

And no, I don't do that because I'd rather not damage my new bike bumping it into an ugly Hyundai driven by a 300lb moron.

That's just Insurance bullshit and expected as they can make money on a driver, not a cyclist. IF Insurance companies can put 100% blame on the drivers all the time without investigation, that's just pure robbery...Typical Insurance company move though.
There may be no law pertaining to speed on a sidewalk but there are rules, read the MTO on that.
In this situation it was not just the blind spot but an incredibly stupid bicyclist riding excessively fast on the side-walk. The driver may have glanced back and saw nothing as the cyclist was not there, but because of his speed he caught up to the car, which is HIS (cyclists) responsibility to watch for also....read the MTO. The cyclist should have watched, slowed or prepared to stop to let the vehicle turn as he is NOT supposed to pass cars on the right, which again is not a law but a rule....read the MTO. Rules are meant for a reason....safety.
Personally I could care less about how Insurance companies presently would view this as they are all thief's anyway, but any 'reasonable' person or Police officer views this clip, they would undoubtedly side with my judgement.
I've had two very similar instances in my driving career (a while back) and both times I was found not at fault by the Law nor did my Insurance find fault nor raised my rates....just saying.

Street racing challenger and Audi. Challenger run out of his lane, left of center by a left turning corolla.
Both drivers are idiots who deserve a nice fat ticket/ points.

10:12 PM Driving north on mt. Pleasant out of downtown tonight and an Audi Q1 or something tried racing a challenger. The Audi SUV had passengers drinking Budweiser holding cans out of the windows. I was behind 1 or two cars watching.
The light turns green, both cars take off. Idiots.

A parked corolla then crosses 2 lanes of traffic ahead to turn left onto a side street. The challenger is cut off, panics and drives left of center. He turned left and took off down manor road or something. The Q1 took off ahead.
Street racing is stupid and very dangerous and if there was more traffic going SB, there could have been a head on collision at speed as the challenger went left of center going 80 kph+
It's on my dashcam and I'll post later in that thread when I go home. Scary s***. Don't street race plz.
